The Private Healthcare Facilities Ordinance (Cap. 633)

Since 30 November 2018 introduced a new regulatory regime for hospitals, day procedure centres, clinics and health services establishments. All private medical institutions are based on premises. DPC should not share the premise with other.

Day procedure centres (DPCs)

refers to premises that do not form part of the premises of a hospital, and that are used, or intended to be used, for carrying out highrisk procedures. These procedures, referred to as Scheduled Medical Procedures, are defined in section 2 of the Ordinance, as a medical procedure that is (a) described in column 2 of Schedule 3 to the Ordinance - Particular medical procedures; (b) not a medical procedure described in column 3 of the Schedule (Exceptions to medical procedures described in column 2); and (c) carried out in an ambulatory setting.

Any requirements for DPC

The day procedure centers must follow The Private Healthcare Facilities Ordinance (the Ordinance) (Cap. 633) and that the patient is discharged in the same calendar day of admission (The expected total duration of procedure and recovery requiring continuous confinement within the facility does not exceed 12 hours), and pursuant to section 103 of the Ordinance, the Director of Health has specified that designated medical procedures may only be performed in hospitals.

Any requirements and guidelines for Operating Room?

Where procedures are performed in an operating room (OT Room) , the requirements relating to operating room (The Guidelines on Use of Operating Room for Surgical Procedures in Day Procedure Centres and the Guidelines for Healthcare Engineering Systems in Day Procedure Centres) for general guidance on the design and installation of operating room. Please note that the regulatory requirements of Healthcare Engineering Systems for Day Procedure Centres will take effect from 1 January 2028.

Easy to modify existing Operation room

Some centers are Day Procedure Centre Licence (Provisional) are required to become Day Procedure Centre Licence. However, their exiting operating room (OT Room) is not fulfill the regulatory requirements of Healthcare Engineering Systems for Day Procedure Centres. We (HKAPC) provide operating room (OT Room) modification / improvement scheme service to evaluate and modify the existing operating room (OT Room) to accomplish the relevant regulatory requirements. Kindly reminder that all non-compliant operating rooms (OT Room) must be proper optimization. After optimization, the center is required to submit the relevant application to Office for Regulation of Private Healthcare Facilities (Department of Health), then the ORPHF will on-site inspection to check and approval the application. Without relevant approval on 1 January 2028, these non-compliant operating rooms (OT Room) must not be used.

Any document should be prepared before inspection?

Furthermore, some clinics are hesitant how to ready relevant documents including policy, procedures and records. We also provide DPCs license service for assisting customers to apply for or change from a temporary to a full day procedure centres license.
